End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and Asobi Labs (Sole Proprietorship of Maria Hollweck) ("Asobi Labs", "we", "our") for the use of the Magica mobile application ("the App").

By downloading, installing, or using the App, you agree to be bound by this EULA. If you do not agree, do not use the App.

1. License Grant

Asobi Labs grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, subject to this EULA and the Apple App Store Terms of Service.

2. Eligibility

Users must be at least 13 years old to use the App.

3. Account Registration

Accounts are created using Sign in with Apple. You are responsible for maintaining access to your account.

4. Subscriptions and Billing

Premium functionality requires a subscription:

Monthly and yearly plans available
7-day free trial for new subscribers
Billing managed by Apple via the App Store
Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period
You can manage or cancel subscriptions in your Apple ID settings

5. Refunds

Refunds are handled exclusively by the Apple App Store. Asobi Labs does not issue refunds directly. To request a refund, visit reportaproblem.apple.com.

6. Content and Intellectual Property

All affirmation content, audio recordings, background music, and visual design in the App are the intellectual property of Asobi Labs or its licensors.

You may not:

Copy, reproduce, or distribute any content from the App
Record, rip, or extract audio files
Use App content for commercial purposes

7. Restrictions

You may not:

Reverse engineer, decompile, or disassemble the App
Modify, adapt, or create derivative works
Interfere with servers or infrastructure
Use the App for any unlawful purpose
Share your account credentials with others

8. Disclaimer

The App provides audio affirmation content for personal wellness and reflection only. It is not a substitute for professional psychological, therapeutic, or medical advice, diagnosis, or treatment.

The App is provided "as is" without warranties of any kind, express or implied.

9. Limitation of Liability

To the fullest extent permitted by law:

Asobi Labs is not liable for any indirect, incidental, special, or consequential damages.
Total liability is limited to the amount you paid for the App in the previous 12 months.

10. Termination

We may suspend or terminate your access to the App if you violate this EULA. You may delete your account and stop using the App at any time.

Upon termination, your license to use the App is revoked. Sections on intellectual property, disclaimers, and liability survive termination.

11. Data Collection and Analytics

The App collects anonymous usage data (e.g., which features are used, session duration, error logs) to improve the product. When you are signed in, your user ID may be associated with this data. We do not use third-party analytics or advertising SDKs. For full details, see our Privacy Policy.

12. Third-Party Terms

Your use of the App is also subject to Apple's App Store Terms of Service. In the event of a conflict between this EULA and Apple's terms, Apple's terms shall apply to the extent of the conflict.

13. Governing Law

This EULA is governed by the laws of New York, USA.

14. Changes to This EULA

We may update this EULA from time to time. Continued use of the App after changes constitutes acceptance of the revised terms.
